The penalty for drink driving in Tasmania depends largely on your BAC, whether you have previous offences and the circumstances of the charge.
For a first drink driving offence dealt with by the court, penalties can include:
- BAC below 0.05 where a zero-alcohol limit applies – a fine of $426–$2,130, licence disqualification of 3–12 months, and up to 3 months’ imprisonment.
- BAC of 0.05 to under 0.10 – a fine of $426–$2,130, licence disqualification of 3–12 months, and up to 3 months’ imprisonment.
- BAC of 0.10 to under 0.15 – a fine of $852–$4,260, licence disqualification of 6–18 months, and up to 6 months’ imprisonment.
- BAC of 0.15 or higher – a fine of $1,065–$6,390, licence disqualification of 12–36 months, and up to 12 months’ imprisonment.
