Getting A Divorce

To get a divorce, you need to be separated for 12 months and 1 day, and reside in Australia. You don't need your partners permission to get divorced, you can do a solo application. You do need to be able to serve the application on your partner so as they're aware that you're applying for divorce.

In most cases, you don't need to attent court, you can elect to have the matter heard in your absence. In this case a registrar will sit down on a given day and consider your application. Provided everything is in accordance with the legislation, the divorce will be granted. 

It doesn't matter if you were married in another country, you can still be divorced in Australia so long as you're in Australia, you consider Australia your home and you've been in Australia 12 months prior to the date of divorce.
